The Greatest Gamer Philippines 2023 Audition
These Terms and Conditions contain all the details related to the program The Greatest Gamer Philippines 2023 ("Program", including the auditions for the Program) hosted by AMPLIFY LIVE PTY LTD (hereinafter referred to as "Promoter” ) and partner with TIKTOK PTE LTD (hereinafter referred to as “TikTok”).
The program consists of an Audition Stage, Semi Final and Final. The Promoter is absolutely entitled to change the Audition Period, Competition Period of this Program and/or any part of these Terms and Conditions without prior notification to the Participants. If you do not agree to any part of these Terms and Conditions, please do not enter the Audition or Program.
By participating in the Audition and submitting your audition video, you are deemed to have accepted these Terms and Conditions (“T&C”):
PROGRAM DATES
The below dates are subject to change in the Promoter’s sole discretion. The duration of the Program is the “Program Term”.
Registrations are open from 24 May 2023 up to 14 June 2023 (“Audition Period”). Registrations must be received no later than 23:59 PHT 14 June 2023.
Semi Finals and Finals shall be held between 28 June 2023 and 22 July 2023 or such other date as notified by the Promoter. (“Competition Period”).
AUDITION STAGE
Do you have what it takes to become Philippines's Greatest Gamer? Make this dream come true! We will give one lucky Filipino a chance to win 250.000 Pesos and contract with Smart OMEGA ESPORTS (“Prize”).
Follow these steps to participate in the Audition:
Create at least one 60-second video (“Audition Video”) using the hashtag #TGGPHAudition and the TikTok Greatest Gamer 2023 Filter, explaining why you want to be Philippines's next greatest gamer and post it on your TikTok account.
Submit your details through the https://www.thegreatestgamer.online/ (“TGG Website”)
By submitting your Audition Video, you are an “Applicant” and accept the following Terms and Conditions:
ELIGIBILITY
This Audition and Program is open to everyone who meets all of the following requirements:
Filipino citizens and domiciled in Philippines;
Male/Female aged 18 years and over;
Have valid identification data for identify verification of participant.
This Audition and Program is not open to employees or contractors of the Promoter and parties related to this Program and their families; including advertising agencies, suppliers, agencies, and third parties in any form that help support Program activities.
Must be available to compete in the Finals and present in Manila, Philippines for the Semi Finals and Finals Period.
If an Applicant is not willing to provide his personal data as necessary for Registration, Tiktok and/or the Promoter will be unable to provide the Offer (as defined below) to the Applicant. By choosing not to provide personal data, the Applicant acknowledges that he will not be eligible for the Program and will release and release TikTok and/or the Promoter from any obligations regarding the Program and undertakes not to make any claims against TikTok and/or Promoter in connection with the Program.
REGISTRATION
By participating in the Audition and Program, you:
Warrant that you meet the eligibility criteria and are available, if selected, to participate and sign all documents necessary for participating in the Program at Semi Final and Final stage;
Warrant that your registration, including the Audition Video, is your own work and does not infringe the rights of any third party.
Grant the Promoter and TikTok (and entities related to the Promoter and TikTok i.e. companies, agents, licensors and assignees) a royalty-free, worldwide, perpetual, transferable and irrevocable license to use, modify, adapt, publish , and sublicense your entries anytime, anywhere in any way without compensation.
Agree to provide your personal data through the TGG Site for any purposes related to Auditions, Programs, Promoters and/or TikTok.
Agree and acknowledge that Audition Videos and/or other submitted registration information that is incomplete, incorrect or illegible will be deemed invalid.
Agree that the Promoter and TikTok may use the personal information (including name, voice, image, photography, likeness and other personal data) that we collect from you:
To carry out the Program, including determining and notifying winners and disclosing such information to third-party providers are necessary to carry out the Program; And,
For marketing purposes of the Program or future versions of the Program in any media, including after the Program has concluded.
SELECTION
A. Criteria
Each Audition Video will be assessed individually for skill, creativity and suitability for the Program as determined by the Casting Committee and/or Promoter in its sole discretion.
Each Applicant undergoing selection interviews and assessment shall be assessed individually according to performance in the gaming skill assessments and suitability for the Program by the Casting Committee and/or Promoter in its sole discretion.
B. Process
All Audition Videos will be reviewed by a panel of assessors (“Casting Committee”) and/or Promoter for the first selection stage.
Applicants who have been selected in the first selection stage will be interviewed via Zoom (to be recorded) or other video call platform.
After the first round of interviews, the short-listed Applicants will be selected by the Casting Committee for the final round of interviews and assessment of gaming skills.
The Casting Committee shall select ten (10) Applicants ("Semi-Final Participant”) to advance to the Semi Finals.
Selected Semi Final Participants will be notified via the email provided at Registration within 72 hours after selection with an offer to participate in the Program (“Offer”). The Semi Final Participants who accept the Offer will be announced on the @TheGreatestGamer TikTok account and in all publications related to this Program on 22 June 2023 or another date decided by the Promoter.
The decisions of the Promoter and the Casting Committee are final and are not subject to appeal.
SEMI-FINALS
A. Semi-Finals
Semi-Final Participants will compete in the Semi-Final stage during the Competition Period.
Semi-Final Participants will stay at accommodation located in Manila or another place determined by the Promoter ("Semi Final Location”).
Semi Final Participants are entitled to complimentary return airfare (from and to the Semi Final Location), accommodation, food and drinks during the Semi Final Period as reasonably necessary for their participation in the Program. All other costs are to be borne by Semi-Final Participants.
On 12 July 2023 or another date determined by the Promoter, the Promoter will determine 5 (five) Semi-Final Participants who will proceed to the Final stage ("Finals Participants”).
Semi-Final Participants who are not selected to become Final Participants must leave the Location and complimentary transport (to their place of residence) will be provided by the Promoter.
B. Finals and Winner
Finals Participants will continue to compete in the Program for the remainder of the Competition Period.
The Promoter will select one (1) winner from the Final Participants (“Winner”) to receive Prize , anticipated to be PHP 250,000 (two hundred and fifty pesos) and a contract with SMART OMEGA ESPORTS.
The Promoter and/or TikTok will announce the Winner's name on the last day of the Final stage or another date determined by the Promoter.
If the Prize is not claimed after 72 hours after being notified by email, or the Winner is disqualified according to these T&C, the Prize will be forfeited and a replacement Winner will be selected to receive the Prize Promoter's discretion.
PROGRAM PARTICIPATION
By accepting the Offer, Semi-Final and Finals Participants acknowledge and agree that:
They must comply with the health protocol and other regulations implemented by the Promoter in accordance with applicable law;
They will be recorded during the Competition Period, and grant the Promoter and TikTok a license to use this recording in various media for any purpose, whether commercial or non-commercial;
They must participate in and cooperate as required in all reasonable marketing activities related to the prize including but not limited to interviews and photo shoots. The Promoter and TikTok have the right to use Semi-Final and Finals Participants comments, photos and name for advertising and publicity purposes in any media at all times without compensation.
GENERAL
For the purpose of these Terms and Conditions, “Participants” refers to both Semi-Final Participants and Finals Participants.
Tiktok and Promoter have the right, at any time, and at their sole discretion to:
Request Participants provide valid proof of identity and/or proof of registration;
To disqualify any Participant at any stage (Audition, Semi-Final and Final) that they believe or suspect has violated these Terms and Conditions, is involved in unlawful acts, or other inappropriate acts, or any actions that are considered to interfere with the running of this Program. Any decision to this effect is final and cannot be appealed.
If for any reason, Tiktok and/or the Promoter is unable to carry out the Program as planned, including due to interference, unauthorized intervention, fraud, technical difficulties or other causes beyond our control, which interfere with or affect the administration, security, fairness, integrity or implementation of the Program, Tiktok and/or the Promoter reserve the right to disqualify any Participant, or to modify, suspend, terminate or cancel the Program, as appropriate.
To the fullest extent permitted by law, the Promoter and TikTok shall not be liable for any losses (including indirect and consequential losses) damages, or personal injuries suffered or incurred in connection with this Program including the provision of goods or services from any entity to Applicants and/or Participants or related parties thereof.
Applicants and Participants shall be responsible for, and Tiktok and the Promoter are not responsible for, any tax liability that may arise from being awarded the Prize or participation in the Program.
Applicants and Participants must not commit, and Promoter and TikTok do not endorse, any act that causes or is likely to result in injury, or is reckless, dangerous, or violent.
To the extent permitted by applicable regulations, the Promoter and TikTok (including their respective officers, employees and agents) are not responsible for and exclude all liability (including those resulting from negligence (except death or personal injury)), or loss or damages (including loss of profits), whether direct, indirect, special or consequential, arising in any way from;
Auditions, Semi Finals, Finals and Programs,
technical difficulty or device malfunction (whether or not under our control);
theft, unauthorized access or interference of third parties;
any variation in the value of the Prize with that stated in these Terms and Conditions;
the emergence of tax obligations borne by the winner or participant; or
use of gifts.
To the extent permitted by applicable regulations, each Applicant and Participant agrees to release, indemnify and hold harmless the Promoter and TikTok from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on the basis of compensation) arising from alleged or actual violations of rights third party copyrights, patents, trademarks or other intellectual property rights, or other rights, any violation of these Terms and Conditions and / or arising out of or in connection with the Applicant or Participant’s activity as related to the Auditions, Semi Finals, Finals and Program.
In the event of a dispute arising from an Audition, Semi-Final, Final or Program, or related to the interpretation of these Terms and Conditions, the decisions of the Promoter and TikTok are final and binding on all parties.
Participants will not assign, sell, transfer, delegate, whether voluntarily or not, by law or not, their rights or obligations under these Terms and Conditions without the prior written consent of the Promoter and TikTok.
If any provision herein becomes illegal, invalid or unenforceable, that term will be removed from these Terms and Conditions and the remaining terms will remain in full force and effect.
These Terms and Conditions will be interpreted and construed in accordance with the laws of the Republic of Singapore and any dispute arising out of or in connection with these Terms and Conditions, including questions regarding their existence, validity or termination, shall be referred to and finally resolved by arbitration administered by Singapore International Arbitration Center (“SIAC”). Such arbitration must be carried out in accordance with the SIAC Rules at the time (the “Rules”), which Rules will be deemed to incorporate by reference into these Terms and Conditions.
